The absconded Deputy Commissioner of Police, Abba Kyari, has been granted bail by the FederalOn July 5, 2023, a possible jihadist attack in Burkina Faso left 15 people dead High Court in Abuja.

Justice James Omotosho granted Kyari bail on Thursday for a charge that he and two of his siblings, Baba Kyari and Ali Kyari, failed to report their assets to the National Drug Law Enforcement Agency.

Justice James Omotosho approved Kyari’s application and granted the defendant conditional bail in the amount of N50 million with two sureties in the same amount.

Justice Omotosho went on to say that the sureties had to have N25 million worth of property within the jurisdiction.

In addition, Kyari and his sureties must provide the court registrar with copies of their most recent passport photographs, their statement of accounts, the title deed to the sureties’ property, and their international passport.

In addition, the judge conditionally approved his release warrant based on developments in a separate case before Justice Emeka Nwite in which he and four others are being tried for drug-related offenses.

The judge ruled that there was no evidence that he would not attend his trial and that he was a flight risk when granting his application.

The Justice said that the NDLEA didn’t deny Kyari’s claim that he was in Kuje prison during the last break-in, but that he didn’t get out when he could.

“On the possibility of the first defendant attending his trial, it is pertinent to state that, according to the affidavits in support of the application, the applicant stated that he was in detention at the Kuje prisons when the jailbreak occurred on July 5, 2022, and he stayed put, despite the fact that he had the opportunity to escape. This is relevant to the question of whether or not the first defendant will attend his trial.

The complainant/respondent did not challenge this deposition, so it is accepted. This shows that the candidate is reluctant to take off from his preliminary and has shown a readiness to go to court when required.

“This fact will benefit the applicant because it demonstrates to the court that the applicant would not jump bail if granted it. I note that decisions have denied bail to the first defendant/applicant.

In addition, he determined that Kyari and his co-defendants are eligible for bail for the charges against them.

He has not been found guilty of a capital offense or to be a flight risk. As a result, I use my discretion in the defendant/applicant’s favor.

The court dismissed further hearing for the situation to October 18.
