“Igbo Coalition Demands Constitutional Clarity on Sharia Common Law Divide in Nigeria’s Legal System”

An Igbo socio political advocacy group has called on the Federal Government to address what it describes as persistent constitutional ambiguity between Sharia and common law systems in Nigeria, urging reforms to strengthen legal clarity, national cohesion, and equal protection under the law.
The group, identified as the Alaigbo Development Foundation, said the coexistence of Sharia courts and common law courts under Nigeria’s federal structure has, in its view, generated legal uncertainties that require careful constitutional interpretation and policy clarity. The Foundation argued that while Nigeria’s plural legal system reflects its diverse religious and cultural heritage, clearer boundaries are necessary to prevent jurisdictional conflicts and reinforce public confidence in the justice system.
Nigeria operates a tripartite legal framework: English derived common law, customary law, and Islamic law (Sharia). Sharia courts function constitutionally in several northern states, primarily handling personal status matters such as marriage, inheritance, and family disputes for Muslims. Since 1999, some northern states have expanded Sharia jurisdiction to include criminal law, a development that has drawn national and international debate.
The Igbo group stressed that its position is not an opposition to religious freedom but a call for constitutional consistency. Citing provisions of the National Assembly of Nigeria and the 1999 Constitution, the Foundation maintained that legal systems must operate within clearly defined parameters to ensure equal citizenship rights across all states.
Legal analysts note that the intersection of Sharia and common law has long been a subject of constitutional interpretation. Nigeria’s Supreme Court has, in past rulings, affirmed the autonomy of states in establishing Sharia courts while emphasizing adherence to the Constitution as the supreme law of the land.
The debate gained heightened attention following the reintroduction of expanded Sharia criminal codes in states such as Zamfara State in 1999, with subsequent adoption by several other northern states. Reports by international and local media, including the BBC News and Reuters, have over the years documented legal controversies surrounding Sharia rulings, constitutional appeals, and human rights concerns.
The Igbo advocacy group has urged the Federal Government and constitutional review committees to initiate inclusive dialogue among religious leaders, jurists, civil society actors, and regional representatives. According to the Foundation, transparent consultation is essential to safeguard Nigeria’s federal character while preventing the politicization of religion in legal governance.
Observers say the issue touches on broader questions of national unity, minority rights, and federalism in Africa’s most populous country. With constitutional review discussions periodically resurfacing at the National Assembly of Nigeria, stakeholders anticipate that debates over the scope of Sharia courts and the primacy of common law could re emerge in future reform cycles.
As Nigeria continues to balance its plural identity with democratic governance, calls for clarity in the administration of justice underscore the importance of constitutional literacy and interfaith dialogue in sustaining long term stability.
