The House of Representatives has amended the Electoral Act 2026 to make dual membership of political parties a criminal offense, punishable by a fine of N10 million or a maximum of two years imprisonment. The amendment introduces three new subsections to Section 77 of the Electoral Act, making it unlawful for individuals to belong to more than one party at a time
Lawmakers argued that dual party membership undermines political integrity, creating complications during party primaries and candidate nominations. However, some members raised constitutional concerns, citing Section 40 of the 1999 Constitution, which guarantees freedom of association.
The amendment prescribes stiff penalties for violators, including a fine of N10 million or two years imprisonment, or both. This move aims to promote transparency and accountability in Nigeria’s electoral process.
