Court Sets November 20 for Atiku’s Fresh Suit Against Tinubu.

The Federal High Court in Abuja has fixed November 20, 2026, to rule on whether former Vice President Atiku Abubakar and the African Democratic Congress (ADC) can amend their lawsuit challenging President Bola Tinubu’s eligibility to contest the 2027 presidential election over an alleged discrepancy involving his National Youth Service Corps (NYSC) discharge certificate.

Justice Inyang Ekwo scheduled the ruling on Tuesday, October 13, after hearing arguments from lawyers representing the plaintiffs, Tinubu, the All Progressives Congress (APC), and the Independent National Electoral Commission (INEC).

The decision will determine whether Atiku and the ADC can revise their original court filings to incorporate additional details and evidence in support of their case. It does not, however, constitute a ruling on the substantive allegations against the president.

Atiku Seeks to Amend Suit Challenging Tinubu’s Eligibility

Atiku and the ADC instituted the suit at the Federal High Court in Abuja, seeking an order to disqualify Tinubu and the APC from participating in the 2027 presidential election.

The plaintiffs allege that a disputed NYSC discharge certificate submitted to INEC in connection with Tinubu’s presidential candidacy contains irregularities. They have questioned the name appearing on the document and challenged its authenticity.

According to News reports, the plaintiffs are asking the court to direct INEC to remove Tinubu and the APC from the list of candidates and political parties for the forthcoming presidential election.

The suit, marked FHC/ABJ/CS/1888/2026, also raises broader legal questions about the president’s eligibility to seek another term in office.

The allegations remain contested and have not been established by a final judgment in this case.

Why Atiku and the ADC Want to Amend Their Court Filing

Atiku and the ADC applied to amend their originating summons after identifying errors and other issues in their initial court documents.

Their legal team argued that the proposed amendments would help correct inaccuracies, clarify aspects of their claims and introduce additional particulars and supporting evidence.

One of the reported issues concerns the description of an INEC electoral form, with the plaintiffs seeking to correct references in their original filings. They also requested permission for the amended originating summons to be recognized as properly filed.

During Tuesday’s proceedings, counsel for Atiku and the ADC urged Justice Ekwo to grant the application. Lawyers representing the defendants opposed the request, presenting arguments against the proposed changes.

Following the hearing, the judge reserved his ruling until November 20.

Tinubu, APC and INEC Oppose the Application

President Tinubu and the APC have denied the allegations concerning the NYSC discharge certificate and urged the court to dismiss the substantive suit.

Their legal team argued that the proposed amendments went beyond correcting errors and could introduce new facts, documents and reliefs into the proceedings.

They also challenged the competence of the original action, arguing that it was filed outside the applicable statutory timeframe and that the plaintiffs lacked the legal basis to pursue the case.

INEC similarly opposed the amendment application, raising objections concerning the competence of the suit, the applicable pre-election filing deadlines and the legal requirements governing the proceedings.

These objections place procedural questions at the centre of the dispute. Before the court can determine the substantive allegations, it must consider the applicable legal requirements and the parties’ arguments concerning the validity of the proceedings.

The court has yet to deliver its ruling on whether the requested amendments should be permitted.

What the November 20 Ruling Means for the 2027 Election

The November 20 decision will be an important procedural development in the legal challenge to Tinubu’s eligibility for the 2027 presidential election.

If the court grants the application, Atiku and the ADC will be permitted to proceed with their case using amended court documents, subject to the terms of the court’s order and applicable legal requirements. Such a decision would not automatically establish their allegations or disqualify the president.

If the application is refused, the proceedings would be shaped by the court’s reasons for rejecting the proposed amendments and the remaining issues before it.

The dispute also highlights the significance of Nigeria’s pre-election litigation framework, under which constitutional eligibility questions must be pursued in accordance with specific legal procedures and timelines.

With the 2027 general election approaching, the case is likely to remain a closely watched political and legal development. Its outcome will depend on the court’s interpretation of the relevant laws, the evidence presented and the arguments advanced by the parties.

For now, the immediate question before Justice Ekwo is whether Atiku and the ADC should be allowed to amend their existing lawsuit. The court’s November 20 ruling will determine the next procedural step in the case, rather than settle the underlying allegations against Tinubu.
